Terms of service
Effective 1 October 2026
These terms apply when you buy a package or the Care plan from NextGen Digital, a trading name of NextGen Digital, registration number not applicable to a sole proprietor. By paying, you agree to them. Where the Consumer Protection Act 68 of 2008 applies to you, nothing in these terms limits your rights under it.
1. Services
We design, build and launch websites as described in the package you buy on our home page, and, if you subscribe, host and maintain them under the Care plan. Anything not listed in your package is outside its scope; we will quote for it separately before doing it.
2. Prices and payment
Prices are in South African rand and shown on our home page. We are not registered for VAT, so there is no VAT to add to our prices. Package fees are paid once-off, in full, upfront through Paystack. The Care plan is billed monthly in advance to the card you register, starting on the date your site goes live or the date you subscribe, whichever is later.
3. What we need from you
You will complete the onboarding form and provide your content within 10 working days of payment. Delivery timelines start when we have everything we need. If we have not received your content within 60 days of payment, we may close the project; see the refund policy for what happens then.
You confirm that you have the right to use everything you send us (logos, photos, text) and that your content is lawful and accurate. You are responsible for the accuracy of the prices, services and policies the assistant is trained on.
4. Reviews and changes
Each package includes two rounds of changes on the preview site before launch. Additional rounds, or changes after launch outside the Care plan allowance, are billed at R650 per hour, quoted in advance.
5. Ownership
Once you have paid in full, you own your content, your domain and the design of your website. We keep ownership of our own tools, templates and code libraries, and give you a permanent licence to use them as part of your website. The website assistant is provided as a service while your Care plan is active.
6. The website assistant
The assistant answers from the information you provide. It may occasionally get things wrong. It is not a substitute for your professional advice, and you should not rely on it for medical, legal or financial guidance to your customers. You can ask us to update or switch off the assistant at any time.
7. Care plan
The Care plan runs month to month. You may cancel at any time by emailing sales@nextgendigital.co.za before your next billing date; cancellation takes effect at the end of the paid month. If you cancel, we will give you a copy of your website files on request so you can host them elsewhere, and the assistant will be switched off. We may change the Care plan price with at least 30 days' written notice.
8. Availability
We aim to keep sites on the Care plan available at all times, but we cannot guarantee uninterrupted service. We are not responsible for outages caused by third-party providers, your domain registrar, or events outside our reasonable control.
9. Liability
To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, such as lost profit or lost business. Nothing in these terms excludes liability that cannot be excluded by law, including under the Consumer Protection Act.
10. Refunds and delivery
Our refund policy and delivery policy form part of these terms.
11. Complaints and disputes
Please email sales@nextgendigital.co.za first; we will respond within 5 working days. If we can't resolve it, either of us may refer the matter to mediation before going to court. These terms are governed by the laws of the Republic of South Africa.
12. Changes to these terms
We may update these terms. The version on this page when you pay applies to your purchase.
